  • 12months OPT planning INDIA visit

    Hi all,

    First of all Thanks to DESIOPT for helping out all our Desi's in USA either its a status problem or any personal problem.

    I need your suggestion on my planning to visit India. I am currently under 12months OPT and it ends on Jan-04-2016. I did not apply for OPT extension yet and I have a plan to visit India in the month of December. Some say its a huge risk. I am planning to apply my OPT extension in August and am planning to fly once I receive my OPT extension card.

    1. So will that be a problem at the port of entry?
    2. My arrival back to USA will be around Jan 16th. I will be leaving USA when am on 12months OPT and entering USA when am on OPT extension.

    Please give me your valuable suggestions as I have to definitely visit India in this december.

        As long as you have a valid F-1 visa and your STEM OPT extension is approved BEFORE you travel, then you should have no problem. The risk is for those who don’t have a valid visa stamped in the passport. The risk is high that they won’t be able to get an F-1 visa stamp at the consulate.

        There is also a risk in planning a trip because you are assuming the OPT extension will be approved by the time you have to leave. If there is any delay, for example, USCIS issues a Request for Evidence, then you may need to cancel the trip. You cannot travel if your OPT extension is pending.             No issues you should have a valid i20 signed within 6 months by your dso, the ead card and a letter from your employer . Your still entering in your f1 visa so no issues .

              If you don't have your STEM extension granted before your current OPT period ends, then it is safe to return to the US before Jan 4th. However, if you get the STEM EAD well in time then you can come back whenever you want to.
