  • Payroll confusion between CPT completion and OPT start dates

    Hello,

Have been following this forum for quite a while. Thanks for all your good work guys. Facing this dilemma on my Payroll run. I have been working for client X through a Staffing company during my CPT period which ended on 15-May-2015. I had applied for my EAD card in advance so that I can continue working even right after my graduation (15th May), but my university had put my EAD card on hold as an academic regulation for checking all my graduation requirements. I was able to receive it only by 1st of June, and hence I could also report for my Employment officially only from 1-June-2015 due to the delay. Though I received my EAD card finally with validity starting from 16-May-2015, my OPT i-20 will show my Employment start date as 1-June-2015. My employer runs payroll 2 times a month and has run my payroll for the period 16th May to 31st May. Calling for urgent help. I have the following queries in my mind:

    1) So is there any problem if my payroll has been run for the period between 16-May-2015 to 31-May-2015? (the date between my CPT completion date and my OPT employment start dates as per the i-20's, though have my EAD approved during those dates)

    2) I understand that the university updates the SEVIS with the Employment start dates mentioned (in my case its 1-June-2015), so will this be a problem later on if my payroll has been run during the period 16-May-2015 to 31-May-2015 though my EAD remains valid?

Your responses are much appreciated and most welcome! Many thanks in advance!
Please suggest what would be the best thing to do in my case!

Yes, this may or may not cause problems as your payroll has been run for the period you were unauthorized to work as per the I20 issued. However your EAD card has start date of 16 May 2015, so don't worry.

Thanks, I'm still confused if this would be fine or not, as I have a feeling this might have an impact on my H1-B and India travel during OPT period. I'm following up with my employer to take back the payroll too for the above mentioned period, but in vain Please let me know if you guys have any alternate suggestions too!
