  • How to know if it would be declined due to late submission?

    My OPT endorsed I20 was issued on March 25, 2015. I got receipt notice from USCIS that my application received date is April 27, 2015, which is not within 30 days and therefore in great risk to get declined.

    The status on USCIS website now is:
    Name Was Updated. On May 14, 2015, we updated your name for your Form I-765, Application for Employment Authorization , Receipt Number.

    The international office said they need to issue a new I20, and I have to reapply OPT. However, the company assigned me to be on board on July 20, which means I can't wait for another 3 months to get my EAD card. Does my current OPT would be declined for sure, so that I should reapply immediately? Or is there any way I can know the exact situation of my application?

        Check your tracking information for the mail you sent to USCIS. If USCIS received it on or before Friday, April 24, then you should be fine. If USCIS sends an RFE and questions that you didn’t send the application in time, you can show them that USCIS received the application on time. However, if you either don’t have tracking (you sent by regular mail, which you should NEVER do when sending something with a deadline) or the mail got there after Friday, then your OPT application will most likely be denied.
        Remember, you only have 60 days from your program end date to apply for OPT. If the circumstances show that you will most likely get denied, then maybe the best option is to withdraw the current application and reapply before the 60 days passes. You may lose this job, but it’s better to lose this job than to get a denial of the OPT application and be too late to re-apply.

          When did u send the packet to USCIS? Was it after 30 days of issue of ur opt i-20?

              Nowhere in the post does it say that the OPT was denied due to 30 days. Not sure why this title was written.
              Anyways I think it would be better to talk to USCIS regarding this. The date they took possession of your documents is falling > 30 days of I-20 issue date. That being said, not sure why they provided you the receipt no. then.

                I am an immigration lawyer and have assisted several clients in the past with such cases. You should schedule a consultation with a lawyer to discuss filing a motion to reopen your case. That may help. Good luck!
