  • Loosing/Changing job while OPT STEM application in processing

    Thank you for all the help provided on this forum!

    I have a strange situation. My OPT in expiring on 15th Jul 2015. I applied for STEM extension under my current employer in mid-april. I received an email stating that my application was received on 28th April and the I-765 with my receipt number in the first week of May. I was not able to see my case status on the USCIS website for almost a month. My case status showed up on the 12th June and it says that USCIS received my application on 13th May. It still says "Case was received". My question is:
    1. Considering this, does that mean my application processing time is 90 days from 13th May? Has anyone faced a similar situation?
    2. if i loose my job before my STEM application is approved, is there a possibility that my STEM application will be denied?
    3. Is it safe to change my job before my STEM application is approved/is processing?
    4. I have no unemployment days till now. Is it safe to be on unemployment while my STEM application is under processing?

        1. The processing time starts from the “received” date on your receipt notice.
        2. Why would you lose your STEM job? You are allowed to work for 180 days while your STEM application is pending after your regular OPT expires.
        3. As long as the new employer is also enrolled in eVerify, you should be fine.
        4. I wouldn’t recommend it if you have a choice.

          You will be fine. It doesn't matter if you loose the job or change your job. Good luck.

            I m also in the same position . I m waiting for the decision.
            I called up uscis n I have been told to wait up to 75 days before you they make the decision.
            I m done with 65 days or something

              Your application is received on 28th April , so it will be the exact date. You might have seen the validation error and after that you see it was received on 13th May. But actually it should have been received on 28th, its just because of the system error. To make sure when it was received, check your Confirmation Notice. Also, create an account, in the account you will see ur case history which will show when it was received.
