Tavel to India july to augst - first H1B approved and OPT Stem Extension Valid till Nov 2016

Hi,

My OPT Stem Extension is valid till Nov 2016. I have applied H1 this year and it has been approved. I want to travel to India in the month of July and return in the 1st week of August.

1)Is it safe to do so??
2) Is it correct that I need not to go for H1 stamping if I am returning in the 1st week of august??

1. Yes, you can as long as you have a valid F-1 visa in your passport. If you don’t have a valid F-1 visa, then don’t travel. If you want to travel, don’t travel until September, so you can get your H-1B stamp and return.
2. You don’t have to go for H-1B stamping. You can return using your F-1 visa, if it is still valid. Even if you get your H-1B stamping done during your trip, which you can do, you would still need to enter on the F-1 visa if you come in August. The earliest you can enter the U.S. using your H-1B visa stamp is September 20 (10 days prior to the start of your H-1B).

Thank you so much for the reply Ms. Lisa Anderson. In regards to "If you want to travel, don’t travel until September, so you can get your H-1B stamp and return", I would still need to travel in the month of July and return in the first week of August. Would it be fine given my situation??
