  • OPT (First attempt) Denied Need Help!

    Hello everyone,

    I completed my program on 10th May.

    So I applied for post completion OPT around first week of 4th March after my new I20 was issued on 16th Feb which means it was within the 30 day period. Then I understand that it was my mistake that I forgot to sign the I-765 form, so they sent the whole package back and told me to sign the I-765 form and the send the same package back which I did. They recieved and the complete package and marked it recieved online for the 27th March. I also recieved the reciept after they cashed in the check.
    And I just checked the UISCIS status check website on 13th June and it says that "on 12 june my OPT request was declined and you will get the reason in mail by 27th June" I cant wait that long. I already have accepted a job offer and we were waiting for the authorization.

    What should I do next? (I am going to contact my university as well as the USCIS people if they would give the reason via phone or something but let me know if there is anything else I should do)
    Please I need help.

        thats very unfortunate...but u have the option of raising motion of appeal with evidences against their decision..u need to talk to ur DSO asap..

          You should have applied for a new I-20 before you returned your packet. Did you talk to your DSO after you got the packet back?

            when u resubmitted, did u submit the valid doc's? docs that did not expire?

              Probably it is the 30 day deadline for the I-20 that resulted in the denial. Best bet talk to your DSO or an immigration lawyer that specilaizes for such situations prior to appltying for MTR....

                You may be able to do a MTR if the situation requires that. I am an immigration attorney and know that MTRs can successfully get you your OPT EAD. Good luck!

                  Hey,

                  I have received a decision saying my OPT is denied on June 19th, I haven't received the letter yet explaining the reasons. Have you received your decision letter? When did you receive it? What were the reasons they mentioned.

                    OPT DENIED, Above 60 days from Graduation

                    OPT DENIED
                    TIME over 60 days from graduation.
                    SEVIS status with school: Completed.
                    Graduation date: may 10, 2015
                    I 20 issue for opt by university: April 3,2015
                    Opt requested application sent: April 30, 2015
                    Opt application received by USCIS: May 6,2015 (Postal Delay)
                    Application should have reached within 30 days but it was a postal delay by USPS, sent by normal mail, which was supposed to reach on May 2 (within time). I did not have money before that.

                    My address was incorrect somehow with USCIS (not at my end or application), when I did not receive any response from USCIS after 3 weeks I called them and they said a letter was sent out to me. But address with them was incorrect so I updated address with them. I asked them if they can send out another copy of the same letter or do I have to submit any documents or did they request any information, they said we are a customer service we do not all the information. If anything is required than we will contact you again with a mail not email or phone. I called them several times but they kept on saying we would inform you when a decision is made about your case.

                    Now if they wanted any other documents from me for the application, I do not know because the only response from them was lost in mail because of incorrect address and they do not have a policy of sending a copy of letter which they said over phone, so if application has been denied because of lack of documents it is also their mistake too as there is no policy for a copy of that letter. My address with university and money order I have sent to them is correct, so either it is my mistake on form or their manual mistake while punching information in their system.

                    On July 10,2015 the last day of my F1 status on SEVIS record, they sent me an email saying "we denied your application for employment authorization, receipt number EACxxxxxxxxx" which means OPT denied.
                    I find it hard that it's just a coincidence that their response came exactly on same date on which my F1 status expired.
                    I called them to ask for a reason, USCIS customer service told me a letter has been sent which should reach within 15days, the letter will have an explanation of why it has been denied and my options from there on.

                    In the mean time I contacted university DSO, they informed me my status with SEVIS is complete, OPT denied and SEVIS ID Locked. So they cannot help me, if I was informed a few days ago I could have maintained my student status by taking admission with some other university or I could have reapplied. USCIS has taken away that opportunity as well, after calling them to request an update, I did not get any answers except wait for a formal letter from immigration services.

                    Present situation is I am waiting for EAD application denial notice so that I can know what are the reasons for denial.
                    I cannot enroll as a student with any university to maintain my student status, F1 is completed and I am out of status according to university.

                    I wish to work in United status in the field of information technology.

                    I have pursued my masters in computer science and an additional certificate in Computer security and information assurance with a high GPA of 3.84.

                    1. What are my options?
                    2. Has anyone been in same situation? Contacted a lawyer, what does a lawyer suggest in such cases? Is there a possibility of petition?
                    3. How many days do I have to file a petition, since I do not have a official letter of denial, I am loosing time because of USCIS postal delay again.

                        Hello Team

                        Thank you for your prompt response on Facebook.
                        I am aware it is my mistake, i take responsibility of the actions and events that lead to it.
                        Right now, i am looking forward to find a solution.
                        I do not have money to take admission in an expensive university and i can arrange only enough for the first quarter (want to look in to monthly payment options)

                        1. I-290B needs to be filed within a week, as my SEVIS is completed, it means i am out of status. Should i hire an attorney for that. What kind of statement would help.
                        2. Can anyone tell me a university that can issue a new I-20 with new SEVIS. i contacted one university, Goldey-Beacom College but they said no.
                        One of helpful contributors suggested "If ur sevis is terminated, you can take admission in any school and apply for re-instatement within 5 months from sevis termination date."
                        What is the process for that ? Is there a university where i can avail CPT from first semester as well ? Is it advisable to avail CPT from second semester in Second masters program in USA over trying in First semester does it reduce the risks of getting an RFE ?

                        3. I want to try to create a timeline,
                        step 1: I-290 B, in August, 2015 first week.
                        What other visa status can i apply for from my present SEVIS completed status/OUT OF STATUS ?
                        step 2: As a plan B take admission in the mean-time from out of status (without leaving USA, University providing option for CPT from first quarter) in August, 2015 first week. Study and avail CPT till decision for H1B next year.
                        step 3: Apply for H1B while pursuing second masters in March 2016

                        What other ways can everyone suggest to me to get in to legal status in USA, to be able to work in near future.
                        All help is highly appreciated.

                        Again i do understand my mistake, i do accept consequences but i do believe that there is a way out. I just seek help. Please be kind, suggest me all the options.

                        F1 student visa started : June 2013
                        f1 visa ends : June 2018
                        Graduation done : May 2015
                        Sevis Completed with present University: July 10, 2015
                        No Blood relation in USA, NO family in USA, Marital Status Single.
                        Work experience: Information Technology.

                          1. You can join in another school. Get back to the country if you have a VALID f1 visa.
                          3. Inorder to file a petition you need to be IN STATUS

                            U will have a choice to apply for I290-B Motion to Reopen submitting new evidence that it was not your mistake

                              Why can't u join another univ? You have 30 days to leave the country. In that 30 days if u can get into a univ then U can stay in US.

                              Also don't blame USCIS for everything. It's your fault too. You are graduating may 10 and you send in your application on April 30. Just 10 days before? You know the normal processing time USCIS provide is 90 days to process opt's
