    Hello everyone,
    My employer has filed an H1b petition for me this year. I am currently working on my OPT. We have not received any response from USCIS whether my file has been selected in this year's lottery or not. Meanwhile I have to travel to India in the month of June. I know that if my H1b is picked this year, my Change of Status gets denied.
    1) What does that mean?
    2) If in case I am not selected in lottery and I get my file back while I am in India, I am safe enough to re-enter or are there any complications?

        1 if cos is denied then u r h1 wont activate automatically on oct 1 ( u may need to go for stamping or need to file h1 with cos)
        2 yes as long as u have valid f1 visa and status

          If we go outside and come back ... Do I need to file H1 again??? As my cos will be denied and what is the time frame that I can use my same H1 as I have 20 months in my opt left??? Can I work on opt for an year and change to h1 next year???

            Yes u can use u r opt time .. Time limit to act on cos is validity of h1 ( generally 3 yrs )

              How to answer these RFE on day 1 CPT:
              1. Evidence that immediate participation in CPT is required for graduate studies.
              2. Evidence that current major/studies + CPT is an integral part of the degree program.
              3. CPT employer agreement letter

                Your employer can easily find out if you have been picked in the lottery or not. If there is no receipt notice, then your employer needs to check with the bank to see if the filing fee checks that were sent to USCIS were cashed. If they have not been cashed yet, then it is highly unlikely that your petition has been picked in the lottery. If the petition was filed via Premium Processing, then you should’ve received an approval or an RFE by now.

                As long as your OPT is valid and your visa is valid, you should not have any issue with returning.
