  • Urgent!! SEVIS transfer and deferred admission after OPT

    Hi all,
    My opt ended on May 15, 2015 and my h1 was not picked in lottery. I have transferred my SEVIS from X to Y university on May 16. Since there is a 5 month timeframe for starting classes at Y university, I wanted to start my classes from fall 2015 (August). But now, I want to defer my admission to January 2016 and can't leave US as I'm having some personal issues and also funding for college.

    1. How can I defer my admission to winter 2016? Will the SEVIS still be active for 5 months after transfer out date?
    2. Should I have to get a new I 20 and new SEVIS if I want to defer admission?
    3. Has anyone had issues exiting and reentering US with new I20 after staying past 60 day OPT grace period?

        1. You cannot defer your admission to January 2016 AND remain in the U.S. You can defer, but you will need to change status to B-2. If you are having issues funding your education, you need to go back home or change to another status.
        2. Most likely, yes.
        3. If you stay past the grace period and you don’t attend classes in the Fall, you will need to get a new F-1 visa, even if the visa in the passport is still valid.

          You need to request that your old SEVIS record be transferred to your new school. This transfer must happen within 60 days after your OPT expires. You are not required to start your new program within that 60-day-grace period, but you must start it within 5 months from the end of the semester or the date your record was transferred, whichever is earlier. The only way is to exit after your grace period ends and renter the country with new i120 with your visa stamped before your classes start in Winter 2016.

            You can not stay in US after your grace period ends. 1. You can defer the admission with same SEVIS you got from your new school but can not stay in US till that time. 2.You can request new i120 from the school for winter semester. 3. I don't think anyone had any issue exiting and reentering the country with new i120. It will be just like a prospective student entering for the first time. Discuss with your international advisor about these..They will advice you better.
