Switching Companies during H1B processing

Hi,

My OPT is valid till June 2015 and is not extensible. I have an offer from Company A, but the start date is in August. Company A will be filing the H1B petition this April 2015. I am right now with a consultancy and looking for opportunities. I am interested to know the options to legally stay in the states and pursue the offer from Company A?

1. The consultancy is also filing my H1B this Apr 2015. So, if my consultancy files the petition this april, I can stay post June without any issues. However, my question is can I quit the consultancy and join Company A by August? Will there be any issues/restrictions to switching companies while H1B is in process? Note that this is not going to be a H1B transfer, as the Company A will also be filing the petition this april.

2. Can I take up an unpaid volunteering job at a not for profit org so that I can work till August and switch to Company A? Is this option feasible, since the employer who is filing the petition is Company A, is it legal to stay in US post my opt end date with the not for profit organization?

What are my other options?

Little complication there, 2 employers can file your H1b and once you application is sent you get a receipt you can go to your DSO and apply for CAP GAP i20. I will not matter where you and for who you work till October bet the selection and approval of H1b will matter after that.... Good Luck
