  • Regarding the start of OPT

    Hi guys,

    My masters will be finished by the last week of November 2015. When shall I file my OPT so as to get 3 chances of H1 filing? What's the deadline to file my OPT after masters? Seems like if my OPT starts late close to the deadline ( somewhere in December 2015 or January 2016), I'll get 3 chances to file my H1? Please help me out.

        Remember, you can try as many times as you want, even from your home country. There is no requirement that you must be in OPT status or be present in the U.S. to apply for H-1B.
        If you want to know how many times you can try for H-1B Cap while you’re in the U.S., it’s 1 or 2 times. It depends on if you are eligible for the OPT STEM Extension, which you have not mentioned.
        1. If you graduate in November 2015 and get only 1 year of OPT by January 2016 and are not eligible for STEM Extension, an employer can file an H-1B cap petition (Master’s Cap) on April 2016 for FY2017. That will be the only chance you get to file an H-1B Cap petition while in OPT Status.
        2. If you are eligible for a STEM Extension, you can file for STEM Extension and get extension until approximately June 2017 (additional 17 months of OPT). In April 2017, you can try again for the FY2018 Master’s Cap. If you don’t get it, you can work until June 2017 with your OPT.

          You shd have started applying once you got your F1 visa for 5 more chances.

            1. preferably 3 months before you graduate
            2. Check with your school International center
            3. If your opt starts at Dec or Jan, you get 3 chances- plan accordingly

              I am In MBA(MIS specialization). I will get 1 year OPT. Am I eligible for 3 times H1B filing or only for 1 year?
