  • Want to apply multiple H1-B, but working full time for a company

    Hi,
    I am currently on OPT STEM Extension and working full time for a Company. The company which I am working for is filing for my H1-B. I want to file another H1-B through another employer. I have all the documents except Client letter and I don't know how I can provide client letter to the second employer as I am working full time and the company I am working for cannot/will not provide Client letter saying that I am a contractor and mentioning employer#2 on the letter. I can get a letter from the company I am working for saying that I am working for them but will that be a client letter without mentioning employer#2 on that letter? All the typical sample client letters I have seen have a line something like this: "Mr.XYZ is working for Company123 and Company123 will not hire Mr.XYZ". If this line is mandatory in a client letter, then there is no way that any company would give a letter mentioning that sentence for their full time employees. Can anyone suggest me a solution for this? Thank you.

        You should not submit the same client letter for 2 different employers. If a 2nd employer is going to file an H-1B for you, it should be for a different job or different client. USCIS did send out RFE’s and Notices of Intent to Deny/Revoke for H-1B’s last year where 2 employers were trying to submit H-1B’s for same end-client position and Beneficiary.

              Look for some consultancy who can file your H1 with In-house project !!

                  Without proper documentation i have seen enough of cases who filed multiple H1B's receiving Intent to Revoke for "approved" petitions from USCIS. Be careful, do not go for inhouse. I will not say that it is not possible to file multiple H1B's from different employers but your attorney (s) and employer(s) need to be aware of it and they need to have a work around for this by considering a Risk Based Approach.

                          Why do you want to apply for Multiple H1's.. You are ruining other genuine applicants. Please don't do it..

                              Most ppl jeopardize other genuine applicants by filing 3 to 4 H1 visas. In my personal exp I've seen many grads from unknown tier-4 units( like Tri Valley) exploiting the OPT, H1 visas for thr personal gains. I wish USCIS takes strict measures this time.
