    Hello,

    These are the details of the issue I am currently facing and I hope someone here can help me.

    They received the OPT package on November 17. I had applied to start my OPT on 2nd Feb, 2015. I checked for updates on the status of my OPT on 4, 6 Feb and there was no update. I received an email on 10 Feb stating that my OPT had begun on 2 Feb.

    In the interim, although I had finished all my coursework in December, I did not receive a grade on one of my courses. I was under the impression that my lack of grade meant that I did not graduate. I tried to reach my professors on 26 - 28 Jan via email to update my grade. My grade got updated on 30 Jan. Now, my graduation date shows as Jan 5. I kept checking my graduation status online on Feb 2, 4, 5, 6 and it did not say I had graduated. So I thought my OPT was not in effect.

    Unfortunately, I was not aware of the rule that I am not supposed to work when I receive my new I20. I thought since I did not graduate yet and did not receive my OPT, I can continue to work with my part time job at the college. So I continued to work. I continued to work part time on Feburary: 3,4,5,10,11 and 12.

    After I received my OPT on Feb 10, I gave my notice immediately and asked me to work on Feb 11 and 12 as notice period.

    [U]After I receive my OPT on Feb 11 stating that my OPT had begun on Feb 2, I got concerned about me working after Feb 2 and reached out to the immigration specialist at my University. I met her today and mentioned this matter to her and she said she would submit my violation of unauthorized work and that I would have to leave the country within 15 days.[/U] I wanted to reach the immigration specialist much before I received the opt on Feb 10 but I couldn't get into the appointments or walk ins. I got in touch with her on 19 Feb and discussed this along with many other concerns that I required clarification for. She said she would get in touch with me today ie 20 Feb. I went to her in the morning and she asked me to come in the afternoon. When I went to speak with her in the afternoon today [U]she mentioned that she checked with the immigration lawyer who said that it was a violation and she has to report it. She showed me the email and said I will have to leave the country in 15 days and asked me to show the ticket once I purchase it.

          If your OPT started on Feb 2, why aren’t you authorized to work pursuant to OPT? You need to go see the attorney yourself and hear directly from the attorney. You cannot be sure that the advisor told everything that is necessary to the attorney. You need to make sure the Advisor does not make a notation or notification until you verify for sure yourself.

            Did you call USCIS on this situation or I mostly sure if they want let you go... if things dont get better talk to the Dean of the school explaining the situation. Even its schools fault that they let you work as they are the one providing the job....

              I suggest you not to depend on your university go and talk to some other lawyer. He might help you out. Don't just listen to your school. Make an appontment with alwyer

                Ok wait. They new I-20 u r talkin about is the OPT approved I-20, correct me if i am wrong. If ur opt has been approved on feb 2 , y shud it be a violation cos on ur first opt , u can work full time /part time / volunteer. I don't really find whats the problem... Even if u were not on approved OPT, i am guessing tht u ve been working in ur school of approved CPT and once opt got approved u shud be fine...

                    Why cant you work at university after Feb 2? If opt kicked in on Feb 2, you should be allowed to work.

                      approach a lawyer immediately and explain him the situation , thats really is a silly thing what they are asking you to leave for,

                        Now make an appointment with a lawyer discuss the facts what you have done. Only a lawyer can help you now.
                        As of my knowledge from your post says that you are doing a non-professional job (like at canteen/at library etc). I have question for you now, how did your school allowed to work at school after you have finished you course work? You are not allowed to work right, your school should not allowed you to work right. So, there is something wrong from your school side. They have applied your OPT I-20 and gave you form I-765 to proceed with OPT application, so they know you have finished your course work and still allowed you to work. I hope only this point may help you at this situation.
                        Don’t hesitate to ask this to your school, if you believe they are wrong.

                          think the immigration officer is trying to defend/protect themselves/school (for their mistake of letting you work) by making you leave. DO NOT LEAVE WITHOUT approaching lawyer. 'coz once you cross country, they don't have to answer you or anyone.
