Error in OPT I-20

  • Error in OPT I-20

    Hi all,

    I am in OPT grace period ( started a week ago) and going to file for H1b. I realized that my OPT I-20 has an error when I was about to send my documents to my employer for H1b filing. The error is on page 3 under employer's information (specifically state - instead of IA, it's written ID). My fault here is that I didn't check my I-20 when I received it (I did submit the correct information to my university though). My DSO is not considering that it was their fault too, rather is not helping and saying that they cannot fix it since OPT period is over. (My SEVIS is active and I did maintain my status through out the time).

    1. Is there any solution to it? Can't they contact SEVIS Helpdesk to fix the error?
    2. Could this be a problem in getting H1b visa?
    3. Shall I get a letter from DSO addressing the errors ? I was thinking to send this letter with my I-20 to the employer for H1b filing.
    4. Or should I just submit my I-20 without the letter?
    5. How long does SEVIS helpdesk take to fix it?
    6. Also, can you tell me if a cap H1b visa filed on April 1 (during OPT grace period) is later rejected / denied/ revoked, do you get additional 60 days from the date of notification of denial or revocation or rejection to change my status or depart the US ? Please note this question is when your H1b was filed during OPT grace period. So you had 60 days grace period after OPT expiration also.
    7. Are cap-gap extension and 60 days grace period after rejection/ denial/ revocation rules not applicable in case of non-cap H1b filing?

        What does your attorney who is filing the H-1B say? You will need to follow his or her advice on what to do.

        If you are covered by Cap Gap (your H-1B is filed while you are still in F-1 status or in the 60-day grace period), and the H-1B is rejected, denied or revoked, you will have 60 days of grace from the date of the action.

          1 if u have cap gap then yes ..
          2 it depends .. Law did not mentioned it for cap exempt scenarios ( as u can get result in 15 days if u apply in premium and for cap exempted u can request immediate start date)
