    EAD Lost in Shipment- Can I apply to H1B?



    Hello Desi OPT. Thank you for doing a wonderful job in answering our questions.



    I had applied for OPT STEM Extension in November 2014 and it got approved in January 2015. My STEM Extension EAD Card was produced and was shipped to my University after which my University sent it to me. During this shipping, the shipping carrier lost my Card (Jan 28 2015). Luckily I have a scanned copy of the new EAD Card sent from my University before Shipping.



    My questions are



    1) What is the procedure to apply for Replacement Card?

    2) What documents should I attach with the new application? I have a scanned copy of the new EAD Card, scanned copy of new I20 and a letter from Shipping Carrier stating they have lost my package. Should I add these documents too?

    3) I have a copy of I20 requesting OPT STEM Extension and also a copy a scanned copy of I20 of STEM Extension approved. Which one should I attach?

    4) Whats the estimated time to get a replacement card?

    5) Can I apply for H1B even though my replacement STEM Extension EAD card is in process?

    I am also in the same boat... The only difference is i am on 1st OPT and lost my EAD card while shipping... Now i am debating weather to apply for new EAD card or can i use the scanned copy of the Lost EAD card for applying STEM extension and H1 ??? Do we require the physical EAD card for any of it >?? if so please advise. Thank You.

        1. You need to re-file the I-765 application with fees since the reason why it was lost is not USCIS’ fault.
        2. You should add those documents in addition to any other documents normally filed with the EAD card. Check the I-765 instructions.
        3. You should attach both.
        4. Anywhere from 2-4 months normally.
        5. Yes, you can apply. You are currently in status and, theoretically, you are even authorized to work. The EAD card was issued by USCIS, and you have a copy. You do not have to stop working while you wait for the replacement card.
