  • OPT Extensiong RFE

    I got RFE for my OPT extension asking me to submit the correct E-verify number or Tax Identification Number of my company. Initially itseemed like a very simple RFE but my company (A) said they are not finding the E-verify number and even if they find the E-verify number, USCIS could not find this number in their system coz the legal entity of company A is closed in Jan 2015 and company A is tookover by company B.

    1. Is this true, if the company's legal entity is closed, the E-verify number doesnot showup to the employer or USCIS could not find it in their database?

    2. Company B asked me to submit the [B]Tax Identification Number of Company A and Name & E-verify number of Company B[/B] along with the HR letter on the Company B's letter stating the take over of company A by Company B. Will this solve my RFE?

    3. If point 2. is the only option now, do I need to inform my DSO about the Name change of my employer (I did not change the employer but the owner/name of the company changed). How should I tackle this issue and draft a letter to USCIS? Is there anyone who faced the similar kind of problem?

    I got RFE on Jan13th and my First OPT ends on Feb 12th. Seems like I can continue to work for 180 days when my OPT Extension request is pending.

      You should definitely inform your DSO of the change in your employer entity as Company A no longer legally exists.
      Company B’s suggestion seems to be correct; you need to submit a letter from Company B explaining Company A was taken over by Company B and that all Company A employees are now Company B employees. You can give FEIN of both Company A and B and give them the new E-Verify information for Company B. This should presumably solve the issue as Company B is e-Verified, luckily. You should also submit a letter reiterating what Company B states in their letter and tell USCIS that the change happened after the OPT application was submitted.
