  • RFE for first time OPT

    Hello,
    I have applied for OPT on Aug 1st , now i received RFE.

    USCIS is asking for ” documentary evidence to establish the proposed employment is directly related to your major of study ” . * * I have not taken ( CPT ) or ( PRE – OPT ) and do not have any offer letter from any company , So how should i respond to USCIS to fulfill the above question .

      Why did the application take so long? It’s been more than 4 months since you applied. If you are not applying for STEM OPT, you are correct that you don’t need a job offer. Your response must state that. You may want to speak with your advisor to see if they will help you draft a response or see an attorney.

          My college DSO has addressed this issue in a letter stating that, she don't have any potential employment or employer till date. she did not work in CPT and there is no proposal of any employment at the time of OPT application. This question on RFE has created confusion for student and me as DSO. Will this be sufficient or do I need to address the issue by writing a cover letter to explain that I will be working in my filed of study, once I receive my opt approval.

            I am an immigration lawyer, and we deal with such RFEs all the time. You need to prepare a very strong brief which shows the work you will do on OPT, how that relates to your degree, and attach your degree and other evidence with it. Feel free to PM me anytime.

                Thanks for your reply, Actually my DSO has address the issue by stating in a letter that I haven't worked before and the question has created confusion for her as a DSO.

                    will this be enough or I need to address this problem by writing an cover letter stating I will be working in the filled of study, once I receive opt approval.

                        Could you please advice me on this

                        Hi All,

                        Thank you for responding to my query in advance.

                        I while applying for OPT attached an offer letter for temporary employment as an Intern and will be working in Finance Applications, IT department with XYZ Technology, Inc.

                        The RFE notice requests" a statement from DSO explaining how my practical training in Finance application directly relates to Master of Business Administration and Management, General."

                        The DSO denied me her statement and instead asked me to write a letter. The contents of the letter are as follows:

                        1. I attached the offer letter with the intention that it will expedite my OPT application process.

                        2. I have however, lost the internship opportunity and I will no longer be able to pursue that job..please find the letter from employer and email correspondence.

                        3. I was earlier pursuing the job in finance since financial management and policies was part of my Masters of Business Administration, General curriculum. Please find the attached Master of Business Administration curriculum.

                        Please advice if it is ok to send this letter and whether the statement from DSO is necessary to respond to the RFE.

                        I have lost that job anyways. And don't wanna loose OPT as well.

                            Hey there,

                            I need urgent help regarding an RFE.

                            I applied for OPT and 2 months later got a RFE- as it turns out, my DSO forgot to include a copy of my passport page in my application package. I am extremely worried as I am not entirely sure whether I should be reissuing a new I-20 (in order to make sure I don't pass the 30 day window of filing), or whether I should just send the passport copy that they asked for. I heard about many people forgetting to sign I-20 or I-765 and having to get reendorsed and refile the entire application. Please advise, this is keeping me up at night.
