  • RFE status but did not receive physical mail from USCIS | 1month

    Hi,

I am currently on F1 visa and had applied for my OPT on 10th Oct 2014. The USCIS received it on 20th Oct and I got the confirmation by mail.
On 17th Dec 2014 USCIS changed the status to "Request for Initial Evidence Notice Was Mailed"(RFE). It is now nearly 1 month but I have not received the physical mail telling what they need from me. I contacted the USCIS 1-800 number multiple times and on 01/06/2015 they raised a service request to send the mail again. My OPT start date is 2nd Fen 2015 and I have a job offer whose start date 9th Feb 2015.
Has anyone here faced the same situation? What can be done?

Have you received a response to the service request? If 15 days passes with no response, call again. You should have your student advisor get involved as well since they can call USCIS to see what’s going on. It’s unlikely that you will have the EAD by Feb 9. Once you get the RFE and you submit response, have DSO help you with getting an expedite. It may be the only option.

Update: I got my RFE physical mail today. USCIS needed proof about my CPT(i had interned for 2 semesters). I mailed them my previous I-20s and offer letters.
Thanks lisaanderson. I and my advisor are now working to expedite the case.

Hi, I have also received a RFE for Initial OPT. I just wanted to know how much more time can it take after I send the requested document. Did you get your EAD in time? I would be really very grateful for your help.

            Hey kshma,
I received my EAD card around 15 days after i sent the docs. If your OPT has started/have a job start date, call the USCIS 1800 number and request them to expedite your case(explaining your situation). They usually oblige(they did in my case).

Thanks a lot for your response. I hope I get my EAD card quickly as my start date is in February. Can expediting a case be done only by our advisor or we can also do it?

              Thanks
