EAD Card approved like 6 months back, but not received the card still

  • EAD Card approved like 6 months back, but not received the card still

    Hi,

    I got my OPT approved like in May, 2014.
    I received my EAD card like twice but as there were some letters missing from my last name on the card, I had to send them back my original card so that they can send me the New Correct EAD card.
    I sent(second time) my card to USCIS on August 26th and they have a status saying that they have received my card and letter, they will let me know if they need anything more.
    As it has been already like 4 months now, I kept on contacting them, so they apologized and asked me to wait for 45 more days.

    As I have started my employment using the I-765 OPT approval letter, my employer has asked me to provide me the Original document by February - 15th - 2015.

    I am just scared what if USCIS takes more time and delay in providing me the EAD card by this date.

    So It will be very helpful, if you can suggest me some ways to expedite this process or even a way to directly go to the USCIS office and talk face to face with them.
    I am wondering if talking face to face helps in this situation?

      Did you never show your employer the previous cards? Or did you send them back before the employer saw them? Don’t you have a copy you can show them? It can take up to 90 days to get a replacement card. You can ask USCIS to expedite if you explain that the employer is requiring that you produce the actual car by February 15, 2015. Also, you may want to speak with an attorney who is experienced with labor laws and I-9 issues to see if their request for you to produce the actual card, even though you have proof that the EAD was approved and you are waiting for replacement, is actually legal.

        Hi Lisa,

        Thanks a lot for your reply.
        I have shown old EAD card copy(Xerox and not the original) to the employer.
        I have already spoken with USCIS regarding this deadline, but they have asked me to wait for 45 more days.
        Is it good for me to talk to Attorney now, or should I just wait till the end of 45 days?

            submit the photo copies and the letters you recived by uscis you will be fine

              Visit a local uscis office and explain them. You are good to work as of now. Don't worry

                You are good to work.
                Just tell them its name change.
                Show the old card photo copy.
                Because new card will usually have same number if its name change.
