    Hello everyone,

    I have a very tough situation here and am devastated. Anyone has the same situation or the knowledge, please help me.

    I got an offer from a big global firm last year. I graduated with a master degree recently and am supposed to start working in January 2nd, 2015. Since my school has the policy only allowing students with graduation date with 3 months to apply for OPT, I applied it on early October. Due to some delay on my school end, USCIS received my application on October 15th.

    The firm I will be working for require new hires to attend their training section before start. The training starts at January 2nd, and I was able to push it back until January 6. To work for such firm is a life-changing event and I had worked very hard to get the offer. So I started the OPT expedite process in December 2nd, and USCIS approved my request to expedite on December 8th. However, until today it is still at the review stage. My firm told me that the latest date I could receive OPT approval is January 5th. Otherwise, they will cancel my offer and may have me start on June 15th instead (they also need to reconsider my offer. So there is a chance I might not get a new offer from them). I realize that my whole situation is very bad for me even If I am able to start on June 15th. Does anyone has similar situations before? What are my possible options? Can my employer file H1b petition for me on April 1, 2015 even I have not started working with them yet?

        1 it happens to lot of people and u can not do anything about it ..
        Yes they can apply for h1b even u r not working for them ..

            I am in the same situation USCIS recieved my application on November 5th and I have training on the 26th of January and I am worried that I will not have my OPT with me at that time. I am also unable to check my case status online which is not helpful

              Now a days USCIS takes 90day to start processing ur application. Once they begin it will all be over in 10-15 days.

                  To expedite, you first call the USCIS customer service number and request for expedite and they will walk you through it. Normally you will receive an email from USCIS within a few days asking for supporting documents. The one I received asked to provide a letter from Employer saying that I must start on a particular day orelse my offer will be rescinded. They need they letter within 48 hours once they send you the email. So I would recommend to communicate with your employer first about the situation before you start expedite.
