I have a pretty complicated situation now.
I am currently in F1 OPT which will end on FEB.,2015. I applied for STEM OPT few months back , but unfortunately I got laid off recently. So, I am assuming that my STEM OPT will be rejected as I am now using my 90 days unemployment. I should mention that STEM OPT application is still pending. My spouse is in F1 OPT. So, I am planning to apply for COS to F2 at the end of MARCH, 2015 (during my F1 OPT 60 days grace period ). My spouse employer will apply for H1B for him on April, 2015 (no H4 for me at that time). I know that H1b gets effective from october 1st, 2015 if it gets selected.
My question is that
1. If My application to COS to F2 is PENDING till the MONTH OF APRIL, 2015 (while my SPOUSE IS IN F1 OPT BUT, HIS EMPLOYER WILL FILE FOR H1B at that time), will I be OUT OF STATUS as spouse applied for H1B , though his status is F1 OPT till 30th SEP., 2015?
