    Hi All,

    USCIS received my case on 23rd Oct and I have a OPT start date of 12th Jan. 2015. My case status has been 'Case Was Received' ever since; no change in status and I am just left with few days. My questions are:


    1) Can I apply for expedition now ? If yes, can I just call them and send my offer letter as I have not included my offer letter while filing?

    2) If I call them on 29th Dec, what are the chances of me getting my OPT/EAD on or before 8th Jan ?

    Similar case. I have applied for expedite twice. Both were rejected . Here's the reply
    Recently, you or your representative contacted United States Citizenship and Immigration Services (USCIS) concerning your case to notify us that you were requesting an expedited review of your case. Below is a summary of what we found and how the issue has been or may be resolved.

    USCIS does not expedite Form I-765 applications that have been pending for less than 75 days for any reason. The applicant is encouraged to file at least 90 days ahead of his/her expiration date so as to avoid a gap in their employment authorization.

      Will that be a problem if they reject my expedition request ? Is it bad just to give it a try ?

      Also, my next joining date would be on 23rd March ! Is it ok if I be unemployed for 75 days as my opt start date is Jan 12th ?

        Yea you can give a try.
        No. It's fine if you are unemployed as you have requested for OPT.

              If you do not get your opt card before your start date, USCIS will change your start date depending on the processing time. It can take upto 90 days to change the status of your application to production.

                it may take upto 90 days even you gave then jan 12 the start day may vary if they take time for processing your request . You can try calling them

                    They will take at least 2 months and 15 days..to send it to production.

                        I have the exactly same scenario, Uscis received my application on 23rd October and my opt starting date is 12th January as well. My status is still showing as "Case was received".

                          You can call up USCIS and make an expedite request if your case falls in the 9 categories they mention. One of them is 'Loss to applicant or company if they don't meet the start date.' If you can provide enough evidence which explains your urgency they will attach a expedite request with your case. Gud Luck!!
