Start date approaching - No change in OPT status

Hi,

USCIS received my OPT application on 30th October 2014 and since then my status has been "Case was received". I am currently working with my employer on CPT, which expires on the 11th Jan 2015. My OPT start date on the application is 12th Jan 2015. My questions are:

1) Can I apply for expedition of my case considering my start date is less than a month away?
2) If I can expedite, what is the process for the same?
3) If I don't receive my EAD by 11th Jan, what are my options? Can my employer just put me on unpaid leave of absence or do they have to fire me and then re-hire when EAD comes?

1&2. Yes but most scenario's they won't consider . Ask your DSO to expedite the process by sending the offer letter.
3. Stop working until you get EAD card.
4. yes , you can take leave !

They received mine on Oct. 20th, and my status just changed to "new card has been ordered to be produced" on Dec. 12th. You can wait for a couple of more days.

had you applied for OPT 90 days before graduation or 60 days after graduating? also, had you applied with the offer letter from employer?

I applied before graduation, and yes, I had the offer letter.

you can send a statement to USCIS that delay is causing the financial loss but as I mentioned earlier they might not consider this for all individuals but sometimes they will!

Try to negotiate with your employer before it's become more complicated

The court will have to decide if it is valid. You don't want to get that far. if your old boss has not hired a lawyer yet, it's better to try to talk to them first.
