Family Emergency travel on OPT

Hi all,

I am on OPT. I had come to US on H4 and converted it to F1. My OPT is valid till Dec 2015.

Can i go to India now? I have a family emergency
Will I have to go for stamping once I am in India
What documents I need to have for stamping
Will I be able to come back on H4

My spouse's company will be applying for GC in next couple of weeks. How will it impact my travel.

1. You will need to go for stamping. You should talk to your DSO or check your school’s website if they have information about what you need for travel. Generally, you need a recently endorsed I-20, your OPT card and the offer letter from your employer.
2. If your F-1 is denied, you can come to the U.S. on H-4 if your H-4 visa is still valid. If not, you will need to get a new H-4 visa stamp and then return on H-4.
3. What stage will be filed: PERM, I-140 or AOS? If it’s PERM, it shouldn’t have an impact on your application.

If you come back on h4, your opt will be terminated.. You have to come back on f1 status..
