  • Forgot to fill few details in form I-765

    Hello,

    I applied for my STEM OPT application recently. The USCIS has received my application and i also got the receipt notice. But later I realized that
    I forgot to fill degree information in form I-765 Question 17 and also checked wrong box, for the first question which asks for "I am applying for".
    I checked "Permission to accept employment" which was supposed to be "Renewal of my permission to accept employment". All my supporting documents are correct. My previous OPT is going to expire on 1st Feb 2015.

    1. Will it be rejected for these minor errors?
    2. So Considering the time frame, should I resend the whole application to USCIS, with all documents again and corrected I-765, along with a check. If I need to do should I attach anything which says that I have already applied once.
    3. Should I just wait for them to reject my application, then reapply again?
    4. How long will it take for them to send incomplete application back?
    5. Should I wait for my check to be deposited. Since according to uscis website "http://www.uscis.gov/about-us/directorates-and-program-offices/lockbox-intake/lockbox-intake-processing-questions-and-answers", deposited check means, you already passed the phase of acceptation or rejection.

    If anybody has went through such situation, please provide me some suggestion.

      1. Application may not be rejected at this point as it has already been receipted, but if it’s otherwise obvious that you are applying for STEM extension, they will most likely issue a Request for Evidence or Notice of Intent to Deny and request information about your degree certificate, etc.
      2. If you are going to re-apply, you should withdraw the first application or then you will have 2 pending applications. It may be better to wait a few more weeks to see if you get an RFE or rejection.

      5. If you have already obtained a receipt notice from USCIS, that means they have cashed the check. Generally, rejections happen in the mailroom itself. If you have a receipt notice, it means it’s gotten past the mailroom.

          I had the similar problem during my OPT Application.i forgot to fill my I-94 number. I called the service center but they couldn't update it manually.so I was asked to send a letter to uscis office with your receipt number ,mentioning your problem and an updated I -765 .

            If you are sure that those were the 2 things you forgot, then just write a letter to USCIS and ask them to update. Send supporting docs along with it. Call the USCIS Service center for further instructions.

              Don't worry ! In the worst scenario they will send an RFE to correct the I-765 or create a service request with USCIS to update the details

                They are not minor errors. USCIS will activate retard alert on your application.
