OPT to H1B Transition with NO STEM Extension
I have a question about my OPT expiration date and filing of my work permit (H1B visa).
I am all set to take up a new job in a company in this December.
My new employer has confirmed, on the offer letter, that they will file my H1B in April 2015.
However, my OPT expires in February 2015.
So I am wondering is there any way I can get an extension on my OPT until April 2015.
If this is possible, I may then be able to file for Cap-Gap and work until a decision on my H1B petition comes out.
I know I may not qualify for the regular STEM extension but, is there any provision that will cover me for mere two months until I can file Cap-Gap?
Especially at a time when I will be actually on the job with an employer who has confirmed about filing my H1B.
