  • OPT STEM denied. What options now?

    Hi,

    I got email today from USCIS and got denied for OPT STEM I-765 application. My current EAD card expired on OCT 3rd 2014 .

    [B]My question is : what options do I have now ? How long can I still stay in USA ?
    If my employer would sponsor me for H1B visa, can I apply now ? would I still have enough time to apply for H1B or do I have to leave
    USA?

        If your current EAD card expired on October 3, 2014, you are considered to be in your grace period now and should leave the country by the end of your grace period (60 days after end of OPT) or change to another status. Alternatively, you can enroll in school again if you get a new I-20 before the end of your grace period.

        Before making concrete plans, make sure to wait for the denial to come in mail to see if any mistake was made or if it can still be appealed.

        An employer can file an H-1B no earlier than April 1, 2015. As your grace period will end well before that, you cannot wait here while the H-1B is filed. Your employer will have to file it as a consular processing case and you cannot return until next September.

          1. join any university to keep your sevis active. i think you will have 60 days grace period.
          3. U cannot apply H1 at this point of time since H1 B quota for fiscal year 2015 is already filled up. Join any univ and keep studying, on April 1 2015 your employer should be able to file your H1.

            did you receive an RFE prior to the denial? if you don't have enough evidence for the extension to go through, you still file an appeal. This will buy you some time to enroll in some small college.

                  Ping me fr more details. Mine was denied last year. You just get ur sevis transferred to a school that gives u cpt n get ur H1 applied next year. U need to buckle up things cos u have 60 days grace from ur last day of Initial OPT if u recieve a denial <which is ur case now>. I guess u still have like 13 days before ur sevis gets completed.

                      Take a new admission into any school tht gives you CPT fron day1. Like sullivan university, harrisburg univ, ksit etc

                              Dude you can take admisaion in any sevp approved college , it aint that difficult , however depending on reason behind denial you can appeal the decision in aao
