OPT Queries

Hello all, i am in some sort of trouble and seeking for some help/advice.

So i have been a student at some XYZ University for more than a year but in this ongoing Fall semester due to some reason i had to transfer to some language institute so i am not with my university. For coming Winter 2015 semester i will go back to my XYZ university again and graduate also in Winter semester. So will my OPT be approved as i didn't enroll in my XYZ university for FALL semester?

As long as you were enrolled in full-time school for the one year (2 semesters) before OPT application, you should be fine. We suggest you go back to XYZ for Spring Semester or try to delay graduation until Sprint 2016 so you can spend 2 semesters at XYZ.

I think as per USCIS as long as you are on F1 status for 1 year, there should be no problem for OPT.

if you get an opt i20 from your univ .you will get the opt .but you may also get an RFE to explain the reason for the change of univ

I have seen these type of cases where it takes a long time for uscis to approve the opt may be upto 8 or 9 months That 's because of going to some xyz university which is now closed .

It depends upon how the university considers so do not panic and ask your DSO and apply for your OPT all the best

As per the law you have to be with school for 1 year to apply for OPT. In your case talk to your DSO they might be able to help you.. Good Luck
