    Hello Guys,

    I am currently on my OPT. I am planning to apply for H1 in April 2015, next year. I have a concern with the paystub's run by my consultancy. Right now on my paystub's, I am paying state tax for the state where my consultancy exists rather than the state where my client exists. My house address also exists on the paystub's which is in the same state as the client.

    Can you please tell me if it will be a problem for filing the H1, as they say we need to submit the paystub's for filing it.

        USCIS will not notice that they are not taking out state taxes in the state you reside. It shouldn’t be a problem. Just remember to file your state taxes as required. If your consultancy is not cutting the taxes for your state, you will most likely owe taxes to the state at the time of filing. Also, remember to file tax return for the state that the consultancy is located so you can get the appropriate refund.

          Not an issue ! At the time of tax returns you can pay state tax for the state where you work!!

                The above he or she is clearly mentioning that the pay roll is completely ran in employers places but not at the clients place so state tax will be the tax at the employers place this completely says that the consultant is literally working at the employers place not the client place this might araise the issue when applying for h1b

                  Even though I work in different states my employer always run payroll with my brother address which is in Chicago ! I didn't got any problem at the time of my h1b filing !

                    If you are working at the client location then you must be run the paystub of that state. So ask your counsaltunt to generate that state payroll otherwise there ll be issues for sure

                      It should not be an issue but raise this concern to your employer and get it changed from your next pay stub to avoid any further confusion.

                              It's better if you change your pay stub address to your clients place because when you file h1 your LCA specifies your client location that means your are in your clients place if your pay stubs are in your companies place they might have a chance to have a rfe
