Do we need to be on F1 for 1 year to apply for OPT?

Hi,

I was on H4 when I got admitted in MS in fall 2013. Then I applied to change my status to F1 in November but due to delay, I got my visa approved in April 2014. Now, I will be completing all my credits this December and want to apply for my OPT but my ISO is telling me that I need to be f1 for full 1 year then only I can apply for my OPT. Please guys let me know what should I do.

Unfortunately, there may be nothing you can do. Schools and DSO’s are split on this issue. Some believe you can do what you are asking, and others believe you can’t. USCIS does approved OPT in these circumstances although some people do receive RFE’s. You’re going to have to convince your DSO that other schools do issue OPT in these circumstances (you’re going to have to Google and do some research). You’ll need to convince here that the worst case scenario is that you get denied which is not really here problem.

The regs say you need to have been enrolled for at least one-full academic year (or nine months) and be in F-1 status when applying. It doesn’t actually say that you have to be in F-1 for that whole time.

That rule is set by u r uni ..
Law says u need to do one academic yr .. The definition of academic yr is defined by u r uni only

I think it's not true , I completed my masters in 11 months and I got OPT without any issues !!
