    Hi there,

    I am currently on post OPT and my F1 Visa expires on september 15, 2015 and post OPT expires Aug 27, 2015. I would like to go to India next year anywhere between March and June and come back in 1 month. As per the US rules, i can enter the US on Sep 14 also (1 day before visa expires). However, i came to know from a couple of friends that while returning to the US, the immigration people in india are trying to give trouble by saying that the F1 visa should be valid for atleast 6 months from departure date. Is that true? What do i do if such thing happens to me while returning back to the US?

    If anyone can provide a website reference, that would be really great.

        I have not heard this happening, but the statement is not correct. You should have a passport that is at least valid for 6 months when you travel, but you technically can travel into the U.S. even the day before your visa expires. I have been able to find this information from a U.S. Consulate website which is simple and on-point: http://amsterdam.usconsulate.gov/visa_validity3.html. However, traveling close to the end of OPT is never recommended. The CBP here in the U.S. do have the authority to refuse you entry.
        You should have no issue with traveling in March-June. Make sure to carry your employment letter with you.

            Thats not the case for VISA but some students from some countries cannot enter US if their passport is expiring in less than 6 months but India has a treaty where you can use your passport until the last date of expiration. As long as your OPT is valid and VISA is still valid, you can come back. Ask the office to check ICE website and ask him to check for the agreement with India.

              I traveled to India and came back to US last month. My visa expires on December. Did not have any trouble, and I traveled through Delhi. It should not be a problem ideally.

                Hey if you are on a contract job till march 2015 and your visa expiered in July 2015. Can i travel in december and come back?

                  As long as your Sevi's and visa active you can enter US without any issues even one day before !

                    You r fine as long as ur passport has more than 6months of validity from ur date of entry into the USA
