Return from India with STEM pending and one week of OPT remaining

Hi,

Thank you for creating this immensely useful platform for all the students. My initial OPT ends in last week of Jan and I have already applied for STEM and received the receipt from USCIS as well. Will I be able to travel to India sometime in Dec and return by ~Jan 20th, with around a week of initial OPT remaining? If I receive my new EAD, I can ask my friend to post it to India. My issue is if I don't receive the card, will I be able to return with only a week of OPT left? Can I show the receipt to the immigration officer?

I am going to assume you have a visa and you only have to worry about issues at re-entry at the border. In order to travel, you MUST return before your current EAD expires. You must have a signed Form i-20 within the last 6 months and should have proof of employment (employment letter and paystubs).

If you have to get a new visa, carefully consider your travel plans. Consulates are always more wary about giving F-1 visas once you are in OPT and have applied for STEM extension as your ties to your home country are getting weaker and your intention to remain in the U.S. seems stronger.
