  • H1b application and deadline?

    Hello everyone,
    I got hired in my major in August. They have committed to sponsor for H1b next year. I am on OPT which expired in July first week. I will be applying for STEM extension(company is e-verified). Now my questions are:
    1). Is it March of 2015 that my company submit the application? Can they apply before March? They havent sponsored anyone before so have been asking me to keep track of things.
    2). Lets say I get denied for STEM extension, and company files the application in March, and I get selected, Can I work without interruption until October(until the actual h1b starts)?

        You will have ample time to file your H1B. Usually law firms or company attorneys file H1B on behalf of the employer.

        1. The application process on your end can start whenever you want but the USCIS will start accepting application starting 1st April 2015.

        2. Surely lottery will occur due to the number of applications exceeding the number of visas that are granted. If your application is selected in lottery you can automatically work until a decision is made by USCIS, this is termed as CAP -GAP. If your petition is approved the Cap-Gap period is applicable until 30 Sep. Starting October 1st you will be on H1B status.

        Also since you have ample time, you do not need to require to file your STEM. You can wait for sometime, if your Opt date is expiring and the H1 petition is still pending, to be on the safe side you can apply for STEM extension.
