  • OPT Approval taking more than 116 days

    Guys, need your help with my OPT. The receive date for my OPT file is on 20th June and since than my file is in "initial review". When I raised a service request before 3 weeks they informed me that, "my case has been put on hold because of pending security checks".

    1. Hiring an Attorney would help ?
    2. Should I contact local congressman ?
    3. what other options do I have ?

    Really appreciate your help in advance.

        Security checks can be unpredictable and even a congressperson’s help may not fix it. USCIS will tell the congressperson’s office the same thing- security checks. The good thing is that when they approve your OPT, they are still supposed to give you the full year as the delay was caused by them (SEE http://www.ice.gov/doclib/sevis/pdf/...nce_042010.pdf, page 13-14, 6.3). Also, you remain in status while the application is pending (make sure you’re checking in with the DSO so your SEVIS account is kept active and open).

            1. Hiring Attorney wont help you,
            2. USICS wont listen to anyone,
            3. You have to wait till the security check completes & In this case you will not have any status issues.

                Take an infopass appointment and some times you might get bit more information than normal call center ppl.

                      My application for OPT- Stem extension was received by them on sept 2 and since then its on initial review. My OPT expires by oct 31st. Wat should i do ??

                        Now a days USCIS easily takes over 90 days. Your best option is to wait. Other options you can try are:
                        1) get info pass appointment to your local field office.
                        2) ask for interim EAD (since you have passed 90days you are eligible for interim EAD) either via info pass or call center.
                        I have no experience hiring an immigration lawyer or talking to local congressman but I have heard lot of advices saying it won't help. Choosing that option is up to you.

                          Any update?

                          Any update on your OPT. I am in a similar situation and it has reached 110 days mark. So worried and frustrated
