OPT Hours (40 hours) Can we work Overtime?

Hi,

Currently i am on OPT and work as a Contractor(Via Staffing Agency in California). Currently due to work load my employer told me that i can put extra hours(Overtime).

But i am not sure on OPT can i work more than 40 hours or not?

On OPT rules it mention that s student can work 40hours per week?

- 1) Can i work more than 40 hours?
- 2) Is it make any issue on my Status?
- 3) do i need to take care while pay for taxes for extra hours? (As my timesheet will show more than 40hours of week)

The rules seem to be silent about working for more than 40 hours, but do say you can have more than one job. How your overtime hours are taxed are a different story and you need to speak with an accountant about that. Generally, F-1 visa holders are exempt from FICA and Medicare withholding (if you’ve been here for less than 6 years and file non-resident taxes) and your overtime earnings are treated the same way.

3 same as regular hrs .. ( ur total taxes are based on yr end taxable income for fed and state )

I am on opt too, I work extra hours . It won't affect any status.

I worked extra hours in both OPT and CPT , It didn't effected anything till now ! Most of the employers won't mention number hours that we worked , they will only mention period in the paystub. I think it's not a problem !
