F1 pre-OPT: WRONG END date in EAD card. Can I start working?

  • F1 pre-OPT: WRONG END date in EAD card. Can I start working?

    Hi,
    I have applied for Pre-OPT with start date 27th sep, 2014 and end date 12th Dec., 2014. I didn't graduate yet. that's why my school DSO told me to apply for pre-OPT at first and then after my graduation (13th DEC., 2014), I can work on POST OPT with my rest of the OPT. So, I have already applied for POST-OPT with start date 13th Dec. 2014 few days earlier. Pre-OPT EAD card was approved before I sent POST-OPT application to USCIS. Now, USCIS has posted my PRe-OPT EAD card with correct starting date but, they gave wrong end date (END date : 26th Sep., 2015). So, my questions are

    1. Can I start working with this EAD card though the end date is incorrect? If I can't start working now, I will lose this job. In the mean time, I will contact USCIS to make this end date correction.

    2. If USCIS don't make correction before 12th Dec. 2014, can I graduate this semster?

        Have you spoken with the DSO yet? There is an error as your pre-completion OPT cannot extend beyond the end of studies date on your I-20. You need to contact USCIS asap. You may be able to begin working, but you should speak with your DSO and USCIS first.
        It’s not clear why you think you can’t graduate even if the OPT is not corrected. Have you submitted the OPT application for post-completion OPT? If you haven’t, you should now. When you submit the application for post-completion OPT, you will need to submit a copy of the card you have just received. You need to explain to USCIS the previous card has been given the wrong expiration date of September 2015 instead of December 2014 and explain that you have contacted USCIS about correcting the mistake.

              You can definitely start working, that happened to me as well. Keep the card until you show it to your employer (typically on the first day), make copies of it, then ask USCIS to correct the end date.
