  • OPT STEM Ext - RFE

    Hi,

    I am a Masters student and I did not receive my degree yet as i have my thesis pending. I have read this notice from USCIS that students are eligible for STEM Ext even if their thesis is pending. So i applied for STEM Ext but received below RFE.

    RFE:
    "In order to be eligible for a 17-month extension of your employment authorization based on post completion optical practical training under the new science, technology , engineering and mathematics (STEM) rule, you must provide USCIS with evidence that the degree has been obtained. Please submit a copy of your degree or of your official school transcript to establish that the degree has been obtained."

    I dont have a degree as my thesis is pending.I have official transcripts but they dont specify that i am graduated and shows i am currently registered for 1 credit for my thesis.

    1.Can someone suggest how i can reply to the RFE?
    2.Any suggestions for good lawyers?

          Yes u need to complete your degree to get 17 months extention

            17 months OPT u have to complete ur degree

                Read the link below. It's from USCIS website and clearly states that you are eligible for OPT STEM Extension even if they have not yet completed the thesis requirement or equivalent for their STEM degree.

                  Not true... The coursework should be completed, thesis can be pending and must be working for an e-verified employer...

                      1 get a letter from uni saying that u only left with thesis .. Reply u r rfe with that ( u may need to include more docs about u r course work to prove that u only left with thesis ) ..

                        For stem extension you need the degree.
