Pre-OPT working hours and H1-B filing during pre-opt

  • Pre-OPT working hours and H1-B filing during pre-opt

    Hello guys,I am willing to apply for pre-opt in october and start date to be feb 5th as I have just one course left in my upcoming spring semester.I wanted to clear following queries

    1.How many working hours do I get to work in pre-opt.
    2.How many days will be deducted from my actual OPT which will eventually start from May 2015.
    3.Meanwhile if I travel India during christmas,how about the I-94 number updation on my OPT records since it will change after I travel outside the USA.
    4.Can I file H1 during my pre-opt.

      1. Generally, during the semester, if you have pre-completion OPT, you can’t work more than 20 hours a week.
      2. You are only allowed a maximum of 12 months of OPT- whether that’s pre- or post-completion OPT. Each day you work in pre-completion OPT will count towards that 12-month max.
      3. Regardless of when and how you travel, all F-1 students are given “D/S” on their passport when they travel.
      4. Yes, you can file H-1B during your OPT.

      A word to the wise: If you are graduating in May 2015 and will begin working in February and you are tryinb to continue working straight after graduation, your OPT will expire by February or March of 2016. This means you won’t be eligible for the “cap-gap” extension in 2016 since your OPT will expire before your H-1B can be filed. You might be wondering why I’m mentioning 2016? There is no guarantee you will be chosen for the H-1B cap lottery in 2015. Plan ahead and proceed carefully.       Also, remember that even if you have only one course left to graduate, you must maintain a full-time student load in order to maintain F-1 status. Also, you might want to speak to your advisor about your eligibility for CPT, depending on your major and your coursework.

          1 20 hrs max while school is in session .. If not in session u can do full time ( more than 20 hrs)
          2 depends on how many days u requested
          3 it will update automatically .

            During break or summer breaks full time or if you got some course pending 20 hrs.. if 20 hrs pre opt then your actual opt period decrease by half the 20 hr pre opt period..if 40 hrs then the same period will be deducted in Post completion opt..Automatic I think or ask dso.. yes you can..
