  • Initial 3 months of OPT.

    Hi...

    Can anyone please help me with my situation? I am currently on OPT and my initial 3 months expire on 15th oct. I have applied for a volunteer job and the company has started the paper work, but they say it will take 4-6 weeks for the completion and then a joining date will be given. On a rough calculation I cant start working before first week of November. I wanted to know that am I legal after 15th Oct if my paper work is in progress? Thank you..

        You are not allowed to have more than 90 days of unemployment time during OPT. You may want to look for another position immediately. While you don’t automatically lose your OPT card, a lot of problems can arise later if immigration realizes you have accrued more than 90 days of unemployment.

          dude, just join a goddamn consultancy....and if this is your first OPT (not STEM extension) then you dont even need employment letter, just fill the form of your International student office, and let them know you are working at so and so company...they dont even verify....

            Boss, Dont Make life to complicated its simple find a place that get you a letter that you are working for them that more than enough for time being, Dont miss the time line as DSO has to update the SEVIS system with information that you provided.... Good Luck

              Stop giving suggestions that may poise issues in the future... Yes no verification is not done but what about the potential RFE's during STEM and H1B applications.... As stated by him the company will provide the offer letter with the actual date of joining which would be a discrepancy later...

                Legally you cannot stay... you will have 60 days after your 90 day unemployment period to either join another university to maintain your SEVIS or leave the country... Staying illegally will jeopardize your future processing may it be H1B or STEM Extension.... It is for you to decide....

                  I didnt mean with the same company, I meant some consultancy, and of course after talking to them, like just join their free online training, for time being
