  • OPT stem Extension RFE

    Hello friends,

    I have got OPT Extension RFE stating to submit list of employers with starting and ending dates, pay stubs, W2's for my Initial grant of OPT.
    here is my case, my initial OPT started on June 3,2013 and ended on June 2,2014. I took unpaid training with my first employer and went to india on November 17,2013 and came back to US on April 9,2014. I Changed employer on April 13, 2014 and now i am Currently working and paid by second employer.

    1)what are my chances of approval ?

    If suppose my OPT Extension gets denied ,
    2) Do i get any time to transfer to another university ? or my sevis gets terminated ?

    3) If suppose my sevis gets terminated , do i need to re-enter with new I-20 from university listed on my F1 Visa ., or i can re-enter with I-20 from any other university.

        As you may already know, you are only allowed to have up to 90 days of “unemployment” during your OPT period. The clock doesn’t necessarily stop when you leave the country. This means that if you travel outside the country and you are unemployed, the unemployment period accumulates. To clarify, unless you are employed when you leave the country and are on authorized leave from your employer or are working abroad for your employer, then your unemployment time continues to accrue while you are abroad. If you apply for a STEM OPT extension, you are eligible for an extra 30 days of unemployment for a total of 120 days for 29 month. Since it looks like you already accumulated about 150 days of unemployment time when you were in India, you may not be eligible for a STEM extension.
        Since a denial of your STEM OPT may affect your status, it would be a good idea to speak to an attorney IMMEDIATELY to discuss your options. Even if you get a new I-20, it may be the best idea to leave the country, obtain a new visa and return.           Submit proper documents that proves you worked unpaid for 1st employer, if possibl parking tickets or bus tickets to the work place from home, etc etc.. If you submit the docs properly, you wil get approved or the chances are great to get approved.. If god forbidden, your OPT gets denied then your SEVIS will be terminated and you need to get out of the country and come back as a new student with a new SEVIS number

            1.Take a letter from your first employer which states that you were on unpaid training , if possible submit a certificate for your unpaid training ! 2. If your OPT extension denied , you need to enter US with new I-94 , you can enter with any university I-20.
