  • Delayed EAD card- 90 day unemployment period ending

    Hello,
    I need some advise urgent advise on how to go about my case.

    I applied for opt in May 2014 and start date is July 7. It had been more than 3 and half months.
    There was a status update that 'Production was ordered on Aug 18 and give us 30 days to mail the card".
    Yesterday again Status updated saying "Production ordered on Sep 8 and give us 30 days to mail the card"
    I called USCIS and they did not give specific why this date was changed but said The card may have been printed but did not pass Quality Check so they may have ordered production again.
    My questions are ,
    1) The 30 days they specified comes to Oct 8, but my 90 day period ends on Oct 5. If I dont receive my card by then, How can I avoid being out of status?
    2) I have heard we can do Volunteer/Unpaid work for 20 hours to avoid being out of status without receiving the EAD. Is this true?
    3) After how many days of ordering production does the USPS tracking number be updated in the uscis site?

    Do let me know if anyone has come across such a case.

        You should speak with your DSO/ISO regarding any questions about your status as they have the most experience with these situations.
        Generally, if the issuance of your OPT card is delayed, USCIS adjusts the start date of your OPT accordingly. So, as long as your OPT was filed on time, your OPT start date is the requested date OR the date of approval, which is LATER. Also, the 90 days of unemployment does not start accruing until your OPT has been approved. So, we can assume that the earliest your 90 days of unemployment started accruing was August 18 when the EAD was originally approved, meaning the 90 days ends in November, not October.
        Keep on checking the USCIS system to see if the card has been sent. The tracking info doesn’t get updated until the card is sent out. There will be a new message when the card is mailed out. Sometimes, USCIS doesn’t update the tracking information so you might have to call Customer Service to get the tracking info.
        Check out http://www.ice.gov/sevis/practical-training/ and the link to their “OPT Policy Guidance” on the bottom. It has this information in there.

          I got the card on the 155th day after I applied.After I got the card I just had 30 days of unemployment left .I requested Uscis to send a new card again since they produced it late.I got the new card and i just lost 10 days of unemployment. So after you get the card, request them to give a new card.Hopefully they'll give it..

                  Dont worry .. In u r case those days count from the day u receive u r card .. As they have proof of when they send those card u dont need to worry ..
