  • CPT expires next August 11 waiting for OPT.

    Hi All,
This page is awesome. I am seeking your help and let me tell you I am very worried at this moment.
My OPT application was received by USCIS on June 25. My case status is under initial review since then. Currently working as a full-time on CPT, which is going to expire on August 11. I have the following questions:
    1. What option do I have if I don't get my OPT on time?
    2. Can the employer run my payroll if OPT comes late? Because I filled the OPT start date as August 12.
    3. I am afraid to loose my job if I have to wait for a longer time to get my OPT.
Thanks in advance for your help. I really appreciate it.

You can keep working for 180 days even after your CPT as long as you have an application active for OPT/ H1B with USCIS. This is called CAP gap extension. Since you are legal to work for 180 days, your employer can run pay roll with out any disturbances. You can call up to USCIS after 90 days of your OPT application asking for status of the application where you can know about the current status.

Hope this helps. Don't worry much about this. I worked for 15 days on CAP gap extension. No worries. Have fun..!!

nope not ture .. 180 day rule is only valid for opt extension ..
cap gap extension is only for who have h1 application pending or approved that is used to cover gap between opt expiry and h1 start date (oct1)

Nope. I work for Amazon. They mentioned the rule that I can work on cap gap as I mentioned. Even my school ISO mentioned the same thing as I mentioned.
You can take me as an example. I worked for 15 days in cap gap between CPT AND OPT

Oh I never knew about the 180 day period. But my OPT I20 does not have any employer name and it just says the start and end date of employment.

I'm the example. I work for Amazon. I am granted to work for 180 days once I show my OPT receipt notice and OPT I20 with amazon as employer.
But I got my OPT card in 15 days and then I submitted.

The comments are very confusing. One says you can and the other says you can't? Any valid links guys?
