OPT Expires Dec 2013-I might not get H1B this year- How to maintain status till April 2014?

I am on my OPT right now which expires Dec 2013 (Non STEM). My employer has filed for H1 this year but my chances are very slim since my application will reach USCIS later this week. My employer is ready to file next year if they have to. Considering my OPT expires in Dec 2013 and Non- STEM can I still extend my OPT till April 2014?

Its not till 2014 April friend it should be till oct 2014. Even if your application gets approved in Apr 2014 you have to wait until oct 2014 to start working on H1. I think the only option you have is to join in another university and maintain your status.

Response from Reader- No you cannot, the only option I see is that you have to register in a university (ITU etc.,) and get CPT and continue your job and attend classes on weekends and apply for H1 in April 2014 and maintain CPT status until oct 2014. Its a pain I know but that's the only option.

if you apply for H1 before OPT expires then only you can eligible for cap gap extension and you can maintain your work authorization till oct even on expired OPT but if you will not make it this year then you have to wait till oct14 to begin your work as you will loose your work authorization after dec13. best way is to meet attorney he will find way for you.

Join some state school or community college which has cheap classes, get your I-20 transferred and stay enrolled till you get your H1. You can always withdraw from your classes once you get your change in visa status.

But joining in itu is not a correct option it is another trivalley. Just check with your cap gap options and see what are your possible options

If there is a lottery, then all petitions received between April 1 and April 5 will be treated as if timely filed. If your petition is received by USCIS on Friday, April 5, and USCIS holds a lottery- your petition should be included in the lottery.

Apply for ITU. It is WASC Accredited and should not have any problem... There are students coming from India, China and other countries coming directly on ITU Visa so It is a good option for you to join ITU.

I am a current student of ITU and I know in and out of ITU. I always found it a worthy option as the courses and university is good and best of all the CPT option as long as you have minimum of 3 GPA.

Whats ITU?

Apply for ITU. It is WASC Accredited and should not have any problem... There are students coming from India, China and other countries coming directly on ITU Visa so It is a good option for you to join ITU.

I am a current student of ITU and I know in and out of ITU. I always found it a worthy option as the courses and university is good and best of all the CPT option as long as you have minimum of 3 GPA.

Hi Amar,

Whats ITU? And can Non STEM apply for CPT there. I am also thinking of options in case H1b doesnt come within OPT time frame.
