  • 17 mth OPT extension approved after initial denial by NSC but the time period is same

    My extension was denied by NSC for unpaid internship on 13 Nov 2013 and now they have approved it on 22 May 2014 and I am back in US to resume my job. However, my EAD card has starting date as 15 Sept 2014 to 14 Feb 2015. I could not apply for H1B in April this year due to the denial. I will be unable to file for H1B coming April too. I was hoping that USCIS would compensate the time that we lost due to their error in decision making in our case but they have given the same time period. Please suggest me what is the best thing to do? Will USCIS be able to compensate the time if requested?

        hmm.. this seems really unfair.. I was assuming that they would provide 17 months from whenever they approve the STEM. you can explain your situation to USCIS and maybe they ll give an extension till at least after april so u can apply ur h1

          Look for some articles online. But I would like to say that even if the error is not resolved you can still apply for H1b. your OPT expires on 15 Feb 2015 you have 60 days to depart and means its around 15 april, per USCIS if some files for your H1b in that duration you can stay in US. But Cant work and wait for the H1b approval to be processed.... Good Luck...

            Hmm u can apply next yr also using cap gap .. But u can not work untill oct1 ..u can stay in us till oct1
