  • Help Needed!

    Hello,

I've applied for H-1B this year through employer A and got an RFE which needs to be answered by July 29th . The chances of my H1B getting approved is almost NIL due to some other reasons. I've my initial OPT valid until Oct 27th 2014. I got a job through a different employer now. So, I've asked my employer A to withdraw my H-1B (which is still in Pending status). I'm now planning to apply for my OPT Stem Extension for which I need a new i 20 from my DSO. I've heard that DSO cannot provide a new I20 if my H-1B is still in pending status. I was wondering how long will it take to get my SEVIS record updated after my H-1B is rejected/withdrawn? Please advise. Thanks in advance!

Assuming that your 1ST OPT expires after your H1B RFE response deadline date (July 29th) Ask your employer to answer the RFE and upgrade to premium processing, in that way you may have decision before your 1ST OPT expires. And then apply for OPT extension.

      Good Luck.

I am an CPT and applied for H1b and got it approved.
At the same time I applied to opt and also got approved. I asked to hold off my H1b activation till my opt is completed which is accepted.
So there is no relation between opt and H1B
