  • OPT Extension with employer at different location

    Hello all,

    I have a question.

    I graduated in August 2013, and my OPT is going to expire in Oct 2014. I am looking forward to apply for OPT Extension.
    My question is: Can I apply for OPT Extension if my company is E-verified in a different state? It is E-verified in Georgia but I am working in Texas. Also, my payroll will be running in Texas. (Georgia branch doesn’t have human resource to run my payroll). My company is ready to report as my employer in Georgia but I will physically be in Texas and getting paid from here.

      Yes. E-verify is mainly done from the employer's HQ office. Employee can work from different client site. You need to get a support letter from your employer affirming that u r paid and working on full-time employment. You need to approach your DSO to issue I-20 subsequently.

        Ritz, thanks for your concern.

        The HQ is in Texas and not Everified. I'm trying to use the Georgia location just to get OPT extension because it is Everified, meaning I wil be working in Texas and getting paid in Texas only. Again, Georgia cannot run my payroll. The full name of company is same in Georgia and Texas.

            everify is federal .. it does not related to state ..
            a company headquarters can be any where in usa ..and people can work any of the branch locations ..
            in u r case it is not a problem .. for stem opt law only requires u to work for a everied employer it does not care about location ..

              Yes, E-Verify means it is a business to determine the eligibility of their employees to work in the United States, it is federal it doesn't depend upon state . So you are good .

                The headquarters are in Texas and I'm working in Texas. Only for the purpose of opt extension I'm asking my employer to report me as an employee from its Georgia branch (Everified). If he agrees to do this, he still have to run my payroll in Texas because there is no payroll department there in Georgia. I mean, I will be present in Texas and getting paid here but will be reported as employee in Georgia. Is this legally possible to do? And can this help in getting opt extended?
