OPT STEM extension - Employer trade name different from legal name

Hello all,

This is quite urgent. Greatly appreciate your help.

My employer's trade name is different from their legal name. Legal name is what is listed in the everify tool.

My I-20 (generated for OPT STEM extension) has the trade name. Now the form I-765 (for employment authorization) asks for the employer name as listed in everify (which would be the legal name of my employer).

What should I do?

1) Do I mention my employer's legal name and mention the trade name in parenthesis? Let me know if something can be done.

2) Or is a new I-20 the only way which can be a little tricky given that I have only 10 more days for the application to reach USCIS.

My company uses trade name everywhere - offer letters, websites, product names etc. but legal name for certain legal purposes (and also in the everify tool). This came to my notice only recently.

Mention the legal name on the form. Request a new I-20 with the legal name from your intrntl services. This would help you avoid a possible RFE.

What ever the company name is in the E-Verify Account.. that should be the one on i-20... Ask your employer for everify number and name as in E-verify account... Make sure you take a new i20 if necessary from your DSO with correct name...If not you will receive an RFE for Name mismatch in E-Verify Records

Should I use trade name or legal name for STEM OPT employer?

I am experiencing exactly same situation. Please help what did you end up using. I have been now one year on STEM. In the school website I reported the trade name. For all forms,documents, letters we use trade name only. Only for legal purpose, business contracts they use legal name dba trade name. My HR provided an everify number and the name on file for that everify number is the trade name. This is what I used in STEM application. Currently school is evaluating if I should change the company name on their website. My H1B is under processing and still waiting to hear from USCIS. My STEM-I20 was created using trade name by the school. Under new STEM rules I did provide a I-983, before STEM -I20 creation, to the school where my HR has filled the company name as legal name DBA trade name.
How will this effect my H1B visa? How did you sort it out?
