  • course load on the H-1 visa?

    hi,
I am interested to know answers to
This is my first Masters in USA.
I am in MBA program ( i will be left with 1 yr opt, being non-stem category). I want to apply for H-1 for April 2015, before i complete my courses (i will be left with 2 courses by that time)

    1. If i apply in April -2015, i will not come under masters quota (as i won't graduate by that time). Should i need to be in my CPT period while i file for H-1 application from USA? Can we get employment hiring letter during F-1 status?
    2. If my H-1 application gets refused, i will continue on F-1 status.
But if my application accepted can i start on H-1 status(By September i will be left with 1 online course of my MBA, the other gets waived as a part of the CPT, if i work in consultancy). My question is Can i completed the course on the H-1 visa?

    Thanks,

Yeah. Its better to be on cpt working with a client letter in hand or if have an employer who can apply h1b with an in-house project and the start date as Sep or so then you need not be on cpt.. I dont know what course but try not doing online courses.. Problems come with USCIS sometimes on that asking for more documents, etc.. If you are planning to do CPT then make sure its 20 hr per week job or your opt might get reduced.. There are ways to complete under H1 visa.. Check with the dso of your university..

To answer ur question in short - yes, you can study on h1 status.

Assuming you have a job while you are on cpt (working 20 hrs per week as per cpt rules) and your employer files for h1 before u finish masters, and your h1 application is accepted before u graduate, then yes you can finish your masters on h1 status.
