I got both STEM OPT and H1B approved, will it be a problem to travel before Oct 1?

  • I got both STEM OPT and H1B approved, will it be a problem to travel before Oct 1?

    My STEM OPT was approved about 1-2 months ago and H-1B was approved like 3 weeks ago. I didn't ask for H1B Cap Gap I-20 since I thought STEM OPT was good enough for the period till Oct 1st.
    1) Am I automatically considered in H1B Cap Gap regardless of my STEM OPT? Or just STEM OPT till Oct 1st, and then H-1B
    2) Do I need to ask for new I-20 from my school or let them know about my H1B approval?
    3) I want to go abroad in first 2 weeks of September. Is it safe to do this with my STEM OPT I-20? Or do I need to get a H-1B stamp in consulate and travel only after Oct 1st?

        1. You will be considered in cap gap till oct 1st as your H1 is approved.
        2. Good to have that i 20
        3. This depends on your initial 12 month OPT period, Visa validity and other constraints etc...cannot advise with the information provided above.

          2 yes for every travel u need to get a travel i20 ..
          3 September is bit risky if u come early sep before sep 15 then not a issue .. If u wish u can go for stamping and come back on h1 after sep 20 ..
