Travel while OPT Extension pending approval

Hi,

I have applied for OPT extension, but I need to travel to India for my wedding, which is on July 4th. My OPT expires on June 16th. I have planned for a 6 week trip from June 4th to July 15th. I will be out of US while my OPT expires. If my OPT extension is not approved till June 16th, will my status become automatically invalid? My plan was to have my EAD sent to India, if I don't recieve it by the time I leave for my wedding. According to my university, I am at risk of losing status because I am outside the country while my OPT is still pending approval. According to my employer, USCIS cannot deny my EAD by law stating that I am outside the country, and I would be permitted to enter with a valid EAD. Any advice would be greatly appreciated.

I may not have answers for any of them and to be frank, it's totally the discretion of the CBP officer at the Immigration counter. Secondly, I know marriage cannot be postponed but are you willing to take the risk. If you are then go ahead.

1 no but u r entry will be difficult ..
I suggest u to come back after u got u r card .. ..
2 hmm nope check ice guidelines ..
3 yes they can not deny u r stem opt because u r outside the country ..
Some times cbp allow (poe) with i20 and passport .. Some times they ask for opt card ..

always listen to the university as long as you are in cpt/opt/stem opt.

I will be facing same issue next year and my university told me to plan all ur dates to leave usa only after u get ead card.

It is always safe to travel after you get ur ead card... If there is no other way you can avoid it then please do what you have to do...you being out of the country will not hamper your chances of getting approval/denial of your OPT... But make sure you find an employer and update it with your dso and get an offer letter from that employer before entering into the US.. Congratulations on getting married... Cheers

I would suggest you to wait until your STEM extension is approved and you receive your EAD card while you are in USA. Better not to take risk!!!

If your out of the country it doesn't mean that uscis will stop your processing it will be in process but your entry might be in a minimal risk if you don't have your opt extension card now in this situation I suggest you to talk to your DSO in university and get a clear picture of retry without a opt extension card . It might help you , your situation is bit tricky to me . But anyhow thank you and all the best wishes to your marriage .
