  • OPT and H1-B filing

    Hi guys,

    I got my OPT on the 22nd of September 2013 and it expires on 24th September 2014. Presently I am working as an Intern for a company and the company said they will convert me to full time by July this year. The company I guess has started doing some preparations for processing my H1-B visa (because they had asked me to fill the H1-B questionnaire and also submit my documents like copies of my passport, visa, I94, I20, transcripts etc). My questions are as follows:

    1.) Do I have to file for an OPT extension? If so, whom do I need to contact and when?
    2.) How long does it actually take to get a H1-B visa (Assuming the company is in a very early process of submitting my documents to the attorney and when do you guys think I should be going to India to get this visa stamped?

    I appreciate your help.

        Firstly if your company plans to file for your H1b they will be filing on 1st April, since lottery is expected due to high turnover of application exceeding the annual visa cap.

        1. If your company files your visa this April, and since your OPT expire in September you do not require to file an extension. If H1b is selected thru lottery the remaining days between your OPT expiry and October 1st will be covered as cap gap period. However, remember you cannot leave the country during your application process and during the cap gar period.

        2. Filing 1st April, visa application processing two months.

        3. Stamping after 15th September.

          i have a question that what is the limit of capGap extention i mean to say how many months we can be on cap Gap extension

            Maximum of 6 months you can be on Capgap, usually from April 1st to September 30th

              From April 1st to September 30th theoretically. Its actually the number of days between your OPT expiration and start of H1B that is October 1st. However, if you are on OPT or OPT ext during this time, you need not be on cap gap extension.

                      If in Premium Processing USCIS will send an email and if its regular you have to wait for a mail....

                        What happens once you find out that were not selected from lottery and opt expires? Leave the job immediately?

                          Denied H-1B Petitions

                          If USCIS denies, rejects, or revokes an H-1B petition filed on behalf of an F-1 student covered by the automatic cap-gap extension of status, the student will have the standard 60-day grace period (from the date of the notification of the denial, rejection, or revocation of the petition) before he or she is required to depart the United States.
